Article 2 - Applicability
2.1 These Terms and Conditions apply to all use of the Website, all orders placed, and every Agreement between Rose and the Customer.
2.2 By using the Website and/or placing an order, the Customer agrees to these Terms and Conditions.
Article 3 - Offers and Prices
3.1 All offers and prices displayed on the Website are non-binding and subject to errors or changes.
3.2 Prices are inclusive of VAT, unless stated otherwise.
Users will be informed of all fees, taxes, and charges (including any shipping charges) they are responsible for during the checkout process and before placing an order.
Prices will be displayed through this application as follows:
- Either exclusive or inclusive of all applicable fees, taxes and charges, depending on which section the user is in.
3.3 Rose reserves the right to adjust prices at any time.
Article 4 - Orders and Agreements
4.1 An order is deemed completed when the Customer places the order on the Website and receives a confirmation from Rose Supermarket.
4.2 Rose reserves the right to refuse orders, for example, in case of pricing errors, stock shortages, or suspected misuse.
Article 5 - Payment
5.1 Payments can be made through the payment methods offered on the Website.
5.2 The Customer is required to make full payment before delivery of the Products.
Information on accepted payment methods will be provided during the checkout process.
Some payment methods may be available only against additional conditions or fees. In these cases, you can find the relevant information in the relevant section on the service.
All payments are processed through third-party providers. Therefore, this application does not collect payment information – such as credit card details – but only receives a notification when the payment is successfully completed.
If the payment through the available methods fails or is declined by the payment processor, the provider is not obligated to fulfill the order. Any costs or fees resulting from the failed or refused payment shall be borne by the user.
Article 6 - Delivery and Execution
6.1. Superrose strives to deliver orders within the indicated timeframe. Delivery times are estimates and not binding.
6.2 Rose is not liable for delays caused by third parties or unforeseen circumstances.
Article 7 - Right of Withdrawal
7.1 The Customer has the right to withdraw from the Agreement within 08 days without giving any reason, unless the Products are perishable or hygiene-sensitive.
Please note, not all orders can be returned. Here are the main points;
Fresh produce, products from the fridge, Saffron, Products that have been mixed with something else after delivery.
(Unfortunately we cannot accept returns of refrigerated items unless they are delivered to us on the same day of purchase)

Article 8 - Liability
8.1 Rose Supermarket is not liable for damages resulting from incorrect information on the Website or improper use of the Products by the Customer.
8.2 Rose Supermarket's liability is in all cases limited to the value of the Customer's order.

Article 10 - Intellectual Property Rights
10.1 All content on the Website, including but not limited to texts, images, and logos, is the property of Rose Supermarket or its licensors and may not be used without written permission. all trademarks, names and logos, or all other details, service/word marks illustrations, images or logos appearing with the service are and will remain the exclusive property of the company or its licensors and are subject to the protection of applicable laws/international treaties relating to intellectual property.
Article 11 - Applicable Law and Disputes
11.1 These Terms and Conditions are governed by the laws of the Netherlands.
11.2 Any disputes shall be submitted to the competent court in the district where Rose Supermarket is established.
Article 12- Sanctions Compliance Policy
Rose strictly adheres to all applicable international sanctions regulations, including but not limited to those imposed by the European Union (EU), the United States (OFAC – Office of Foreign Assets Control), and the United Nations (UN). In full compliance with these legal frameworks, Rose does not engage in any business transactions, directly or indirectly, with individuals, entities, or countries subject to economic, trade, or financial sanctions.
As part of this commitment, Rose does not conduct any trade, financial transactions, partnerships, or commercial relationships with entities, individuals, or organizations located in or affiliated with sanctioned jurisdictions, including but not limited to:
• Cuba - North Korea - Iran- Russia And any other country, entity, or individual listed on international sanctions lists, including the EU and U.S. sanctions programs.
